The apex court on Wednesday dismissed the plea of ​​all state boards, CBSE, ICSE and National Institute of Open Schooling (NIOS) to cancel the 10th and 12th class physical examinations, saying such petitions give false hope to students and only create. More confusion.

A bench headed by Justice AM Khanwilkar condemned the petitioner’s counsel for making such an application saying that the authorities are more aware of the ground realities and are able to decide that the court should not interfere.

“Such petitions give false hope to the students. Entertaining such petitions is causing confusion in the system. What kind of petitions are being made?” Ask the apex court.

The bench said that its order of last year to suspend the examination could not become a rule to pass the same order for this academic year.

“This petition is ill-advised and premature. The authorities have not yet decided on the rules and dates of the examination to the concerned board. If the decisions are not in accordance with the rules and regulations, the aggrieved persons will be open to challenge the matter,” the bench said while dismissing the petition.

The apex court said that it had refrained from imposing a cost, but added that if the petitioner re-filed such a petition, exemplary charges would be levied.

CBSE Term 1 Class 10 board exams started from 30th November and lasted till 11th December and 12th class board exams lasted till 22nd December.

For the first time, the board is conducting board examinations in two phases due to the Kovid-19 epidemic.

The term 1 test was conducted purposefully, meaning the question paper had multiple choice questions (MCQ).
